These terms (“Terms”) govern your use of the website at bipsglobal.org (the “Site”), which is run by Bureau of International Professional Standards Ltd., a company registered in England and Wales under number 00000000, whose registered office is at 20 Certification House, London EC2A 0AA (“BIPS”, “we”, “us”). By using the Site, you agree to these Terms. If you do not agree, please do not use it.
Please read these Terms with our Privacy Policy, Cookie Policy and Disclaimer.
About us and the Site
BIPS develops competency frameworks, professional certification pathways and accreditation programmes that connect education, industry and employment. The Site gives information about this work and lets you contact us and, where offered, apply for our programmes.
“You” means anyone using the Site, including individuals, employers and education or training providers. You must be 18 or over to use the Site for an application or to contact us. If you use the Site for an organization, you confirm that you have authority to bind it.
Applications, certification and accreditation
The Site describes our frameworks, pathways and programmes. A description is an invitation to apply, not an offer. A contract for a certification or accreditation is formed only when we accept your application in writing under the programme terms that apply.
We decide certification and accreditation outcomes on the published criteria and by our own assessment. We may change a framework or criteria to keep them up-to-date. We will tell people already in an assessment if the change affects them.
Using the Site
You agree to use the Site lawfully and fairly. In particular, you agree not to:
give false or misleading information, including about your qualifications or identity;
claim a certification or accreditation that BIPS has not awarded you, or misuse a BIPS name, logo or certificate;
try to gain unauthorized access to the Site, our systems or other users’ data;
introduce viruses or other harmful code, or overload the Site;
copy or scrape the Site for use in a competing service, or to train artificial intelligence models, without our written permission; or
use the Site in a way that breaks the law of the UK, the EU, India or any other country that applies to you.
If you have an account, keep your login details private and tell us promptly if you think someone else has used them.
Intellectual property
BIPS and its licensors own the Site and everything on it, including our frameworks, criteria, assessments, certificates, text, graphics, names and logos. You may not copy, adapt, sell or share our material more widely without our written permission.
If you send us material, you keep your rights in it. You give us a non-exclusive license to use it only to deal with your enquiry or application, and you confirm that you are entitled to send it.
Your personal data
We handle personal data as set out in our Privacy Policy and Cookie Policy. If you give us another person’s details, for example a colleague or a candidate, you confirm that you may do so and that you have told them how we will use their data.
Links and third parties
The Site may link to other websites. We do not control them and are not responsible for their content or privacy practices. A link is not an endorsement.
Availability and changes to the Site
We try to keep the Site running and accurate, but we cannot promise that it will always be available or free of errors. We may update, suspend or withdraw any part of the Site at any time. We will not be liable if the Site is unavailable for reasons beyond our reasonable control.
Our responsibility to you
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that the law does not allow us to limit. Your statutory rights as a consumer are not affected.
Subject to that:
The information on the Site is general information. Please see our Disclaimer.
We are not liable for loss of profit, revenue, business, goodwill or data, or for indirect or consequential loss, arising from your use of the Site.
If you are using the Site for business, our total liability to you for anything connected with the Site is limited to £10.
If you are a consumer, we are liable only for losses that are a foreseeable result of our breach or of our failure to use reasonable care and skill. We are not liable for business losses.
Suspension and ending access
We may suspend or end your access to the Site, or to any account, if you break these Terms or misuse the Site. We will tell you why where we reasonably can.
Changes to these Terms
We may update these Terms to reflect changes in our services or the law. The version on the Site on the day you use it applies. If we make a material change, we will give notice on the Site.
Complaints and disputes
If you have a complaint, please write to enquiries@bips.example. We will acknowledge it within fourteen (14) working days and aim to reply within thirty (30) days. If we cannot resolve a dispute, we will try mediation before either of us goes to court. This does not prevent you from using the rights you have as a consumer.
Governing law and courts
These Terms, and any dispute connected with them or the Site, are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that:
if you are a consumer, you keep the protection of the mandatory consumer laws of the country where you live, and you may bring a claim in the courts there (for example, in Scotland, Northern Ireland, an EU Member State or India); and
we may seek urgent court orders, such as to protect our intellectual property, in any country.
General
These Terms, with the policies they refer to, are the whole agreement between us about the Site.
If a term is invalid, the rest of the Terms still applies.
No waiver, if we do not enforce a right straight away, we can still enforce it later.
Only you and BIPS may enforce these Terms. The Contracts (Rights of Third Parties) Act 1999 does not give rights to anyone else.
We may transfer our rights under these Terms to another organization if it will treat you at least as well. You may not transfer yours without our consent.
